1. Important notice
- STRV is a wellness and fitness application, not a medical service.
- Workout, nutrition, recovery, and AI recommendations are educational and general in nature.
- You must use independent judgment and seek professional advice before acting on recommendations.
- If you think you may have a medical emergency, call emergency services immediately (in Australia: 000).
2. Eligibility and account registration
- You must be legally able to enter into a binding agreement.
- STRV is intended for adults. If minors are permitted in your jurisdiction, use must be supervised by a parent or legal guardian.
- You must provide accurate account information and keep it updated.
- You are responsible for account credentials and all activity under your account.
3. Health, nutrition, and workout disclaimer
- STRV does not provide medical advice, diagnosis, treatment, medical nutrition therapy, physiotherapy, or emergency care.
- STRV does not create a doctor-patient, dietitian-client, or coach-client relationship.
- Any meal, calorie, macro, supplement, workout, exercise, training load, recovery, readiness, or progression recommendation may be unsuitable for your circumstances.
- AI outputs may be incomplete, inaccurate, outdated, or unsafe for your goals, medical history, or medications.
- You must check recommendations before acting and stop activity immediately if you experience pain, dizziness, faintness, chest discomfort, unusual shortness of breath, or other concerning symptoms.
- If you are pregnant, breastfeeding, under 18, living with an injury or medical condition, or using medication, consult a qualified healthcare professional before using STRV recommendations.
4. Assumption of risk
You acknowledge that diet changes, supplementation, physical activity, resistance training, cardiovascular exercise, and behavior-change programs carry inherent risks, including injury and adverse health outcomes. To the extent permitted by law, you voluntarily assume those risks when using STRV.
5. Subscriptions, billing, and renewals
- Paid features may require an active subscription.
- If you subscribe through Apple App Store or another marketplace, that platform processes billing and renewals under its own terms.
- You can manage renewals and cancellations through the platform where you purchased.
- Unless required by law (including non-excludable rights under the Australian Consumer Law), fees are non-refundable once billed.
6. Acceptable use
You agree not to:
- Use STRV for unlawful, abusive, fraudulent, or deceptive conduct.
- Attempt to reverse engineer, disrupt, or interfere with the service.
- Bypass security controls, scrape protected data, or access data you are not authorized to access.
- Use STRV in a way that violates third-party platform rules (including Google, Apple, and Strava terms where applicable).
7. Third-party services and integrations
STRV integrates with third-party services (including OpenAI, AWS, Supabase, Apple APNs, Google authentication, and optionally Strava). Your use of connected services may also be governed by those providers' terms and privacy policies.
STRV is not responsible for downtime, content changes, policy changes, API limitations, or other functionality constraints imposed by third parties.
8. AI features
- AI outputs are generated probabilistically and may contain errors or omissions.
- AI outputs are informational and do not replace qualified professional advice.
- You remain responsible for all decisions, actions, and outcomes based on AI outputs.
9. User content and license
- You retain ownership of content you submit (for example logs, notes, and uploads).
- You grant STRV a limited license to host, process, and display that content solely to provide and improve the service.
- You represent that you have all rights needed to submit and use that content.
10. Intellectual property
STRV, including software, branding, designs, and underlying technology, is protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, license, sell, or create derivative works.
11. Service availability and modifications
We may update, suspend, or discontinue features at any time, including to maintain security, reliability, and legal compliance. We are not liable for feature changes made in good-faith product operation.
12. Termination
- You may stop using STRV at any time.
- We may suspend or terminate access for violations of these Terms, abuse, security risk, legal requirements, or non-payment.
- Sections intended to survive termination remain in effect (for example, IP, disclaimers, liability limits, and dispute terms).
13. Australian Consumer Law notice
Nothing in these Terms excludes, restricts, or modifies rights that cannot be excluded under applicable law, including the Australian Consumer Law. Where consumer guarantees apply, remedies are available as required by law.
To the extent permitted by law, where any non-excludable guarantee is breached and liability may be limited, our liability is limited to re-supply of the services or payment of the cost of re-supply.
14. General disclaimers
STRV is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.
15. Limitation of liability
To the maximum extent permitted by law, STRV and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business interruption arising from your use of the service.
Where liability cannot be excluded, liability is limited to the greater of (a) the amount you paid to STRV in the 12 months before the event giving rise to the claim, and (b) any minimum amount required by law.
16. Indemnity
You agree to indemnify and hold harmless STRV from claims, liabilities, damages, and expenses arising from your misuse of the service, violation of these Terms, or infringement of third-party rights.
17. Governing law and disputes
These Terms are governed by the laws of New South Wales, Australia, unless a mandatory law in your jurisdiction requires otherwise. Courts of New South Wales have non-exclusive jurisdiction, subject to mandatory rights and forum protections available under applicable law.
